KEWAJIBAN DAN TANGGUNG JAWAB NOTARIS DALAM MELAKSANAKAN PELAYANAN SOSIAL KEPADA MASYARAKAT

Abstract

The purpose of this study is to discuss the obligations and responsibilities of notaries in providing social services according to their position to the community. The main issue to be studied is the obligations and responsibilities of notaries in carrying out social services to the community and the legal consequences for notaries who do not carry out their obligations to provide social services to the underprivileged. This research is considered a sociological legal research. The object of this study is a deed made through social services provided by notaries Agus Zulkarnain, S.H., M.Kn and Sri Widiyanti, S.H., M.Hum., M.Kn to their clients. The subjects of this study are notary Agus Zulkarnain, S.H., M.Kn, Sri Widiyanti, S.H., M.Hum., M.Kn, and clients. The approach of this research is a legislative approach, a sociological approach, and a case approach. Data collection techniques by means of interviews and study of documents and literature. The data analysis used in this study is qualitative descriptive. The results of the study show that notaries Agus Zulkarnain, S.H., M.Kn. and Sri Widiyanti, S.H., M.Hum., M.Kn. as of 2025 will only receive 14 deeds and 9 deeds made for free.  The obligation of notaries in providing free services to the underprivileged community is able to face various substantive and technical obstacles. The absence of clear and measurable legal parameters to define "incapacitated persons" gives rise to multi-interpretations and inconsistencies in its implementation, so it relies heavily on the subjective judgment and individual sensibilities of the notary. Weak supervision from the Regional Supervisory Council (MPD), Regional (MPW), and Central (MPP) and low public awareness of their rights cause the effectiveness of this article to be suboptimal.
